These Terms of Use (“Terms”) apply to your use of www.clouddreamhomes.com (the “Site”), operated by Cloud Dream Homes PLLC (“Cloud Dream Homes,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Using the Site

You may use the Site to learn about our stays and services, contact us and book stays for personal, lawful use. You must be at least 21 years old to book a stay, and the person who books must be a guest for the full stay.

Bookings

When you book a stay on the Site:

• Your booking is also subject to our Guest Policies, our Cancellation Policy, the house rules for the home and that property’s rental agreement. The rental agreement is provided before arrival through your guest portal, and we will send it on request before you book. If those documents conflict with these Terms about your stay, the signed rental agreement controls, then the house rules, then the Cancellation Policy and Guest Policies, then these Terms.
• Prices, taxes, fees and any security deposit or damage protection are shown at checkout before you pay. Payment is processed by our booking and payment partners. Applicable state and local lodging taxes are collected as required by law.
• A booking is confirmed only when you receive a confirmation from us. We use a guest ID verification service and may require identity verification and a signed rental agreement before you receive check-in details, and we may cancel a booking with a full refund if verification is not completed.
• Occupancy. The number of guests and vehicles may not exceed the maximum stated in the listing or allowed by local rules. Parties and events are not allowed unless we approve them in writing.
• Security deposit and damage. You are responsible for damage, missing items, extra cleaning, rule violations (such as smoking, unapproved pets or excess occupancy) and any fines charged to us because of your stay. We may charge these to your payment method or security deposit as described in the rental agreement, and we will give you an itemized statement. Security deposits and damage waivers vary by property and are shown on each home’s listing or at checkout before you pay.
• Cancellations and early departure. Refunds follow the Cancellation Policy. We may end a stay without refund if guests seriously break the house rules or the law, or create a safety risk.
• Changes we may need to make. If a home becomes unavailable because of events outside our control, we will try to offer a similar home or give you a full refund of amounts paid to us.
• The person who books is responsible for everyone in their group following the house rules and these Terms.

If you book through a platform such as Airbnb, Vrbo or Booking.com, that platform’s terms, payment rules, cancellation policy and dispute processes govern your booking and payment. Our house rules and rental agreement still apply to your stay to the extent the platform allows.

Accuracy of listings

We work to keep photos, descriptions, amenities, prices and availability accurate. Errors can happen, and details can change. If we find a material error in a booking, such as a wrong price, we will contact you and either correct the booking or, if you prefer, cancel it with a full refund of amounts paid to us.

Your conduct

When using the Site, you agree not to:

• Give false information or book for someone without their permission.
• Use the Site for any unlawful, fraudulent or harmful purpose.
• Send spam, abusive messages or harmful code through our forms or chat.
• Try to get into parts of the Site or our systems you are not allowed to access, or disrupt how the Site works.
• Copy, scrape or collect content or data from the Site by automated means without our written permission.

Owner Portal

The Owner Portal is for homeowners who work with us. Keep your login details private. You are responsible for activity under your account. Your management agreement with us governs our services to you, and it controls if it conflicts with these Terms.

Intellectual property

The Site and its content, including text, photos, logos and design, belong to us or our licensors and are protected by law. You may view and share Site pages for personal, non-commercial use. You may not copy, change or use our content for other purposes without our written permission.

Copyright complaints

If you believe content on the Site infringes your copyright, send a notice to the contact below with your name and contact details, a description of the work, the page address of the content, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. Accessibility

We want the Site to be usable by everyone, including people with disabilities. If you have trouble using any part of the Site or need information about a home’s accessibility features, contact us at info@clouddreamhomes.com or 801-506-2551 and we will help.

Third-party links and services

The Site links to and uses services from other companies, such as booking platforms, scheduling tools and social media. We are not responsible for their content or practices.

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Site will be uninterrupted or error free. Information on the Site, including guides and journal posts, is general information and not legal, tax or financial advice.

Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site. Our total liability for any claim related to the Site will not exceed the amount you paid us for the booking involved. Nothing in these Terms limits liability for our gross negligence, willful misconduct, or any liability that cannot be limited by law. Some places do not allow these limits, so they may not apply to you.

Indemnity

You agree to cover our losses and costs, including reasonable legal fees, from claims arising from your misuse of the Site or breach of these Terms.

Governing law and disputes

If you have a dispute with us, the terms below apply. For homeowners who work with us, the dispute resolution and venue terms in your management agreement apply to disputes about our management services.

Informal resolution first. Before filing any claim, you and we each agree to send the other a written notice describing the dispute and the relief requested, and to try in good faith to resolve it informally for 30 days after the notice is received. Send your notice to info@clouddreamhomes.com or to our mailing address below. We will send our notice to the email address you gave us. Time limits for filing a claim are paused during this 30-day period.

Governing law. These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. For a stay at a home in Idaho, or any other state, that state’s law applies where it requires that its law govern, including laws on landlord and lodging matters and consumer protection.

Courts and venue. Any dispute that is not resolved informally will be brought only in the state courts located in Davis County, Utah, or the United States District Court for the District of Utah, and you and we agree to their personal jurisdiction. This does not apply where the law of the state where the home is located requires that a dispute be heard in that state, in which case the dispute may be brought in the courts of the county where the home is located. Either party may instead bring an individual claim in small claims court in the county where you live or where the home is located, if the claim qualifies.

Bookings through other platforms. If you booked through Airbnb, Vrbo, Booking.com or another platform, that platform’s terms control your booking, payment and the platform’s dispute process, to the extent they conflict with this section.

Severability. If any part of this section is found unenforceable, that part will be limited or removed only to the extent needed, and the rest of this section and these Terms still apply.

Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the effective date above. Using the Site after a change means you accept the new Terms. Changes do not affect bookings already confirmed.
